1. Acceptance of Terms
By accessing or using Listings.sg (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.
2. Services Description
Listings.sg is a technology platform and property search aggregator that connects property seekers with property agents, landlords, and property owners in Singapore. Our Services include property listings, agent directory, property search tools, AI chat assistance, HDB and URA transaction data, and communication channels between users. Listings.sg is not a licensed estate agency and does not engage in "estate agency work" as defined under the Estate Agents Act (Cap. 95A).
3. User Accounts
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are solely responsible for all activities that occur under your account.
- You must provide accurate, current, and complete information during registration.
- You agree to promptly update your account information to keep it accurate and complete.
- We reserve the right to suspend or terminate accounts that violate these terms.
4. Listings and Content
- Users who post property listings must have the legal right to list such properties.
- All listings must be accurate, truthful, and comply with applicable laws and regulations.
- Listings.sg reserves the right to remove, edit, or reject any listing for any reason without notice.
- You retain ownership of the content you post, but grant Listings.sg a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content.
- Listings.sg is not responsible for the accuracy of listings or other user-generated content.
- By using the Listings.sg platform, agents agree that property listings they have on other platforms may be indexed and displayed on Listings.sg. Listings.sg does not bear any responsibility for these indexed listings.
- For listings indexed from other platforms to Listings.sg, these will remain the exclusive property of the original listing agent. Listings.sg will ensure that these listings are properly attributed to the original listing agent and are not misrepresented as being listed by other users.
- Listings.sg acts as a neutral platform that facilitates property transactions and does not favor any particular user over others.
5. Agent Conduct and Obligations
- Real estate agents must hold valid licenses from the Council for Estate Agencies (CEA) in Singapore.
- Agents must provide accurate information about their credentials, experience, and affiliations.
- Agents must adhere to the Code of Ethics and Professional Client Care established by the CEA.
- Agents must respond to inquiries in a timely manner and honor scheduled appointments.
- Agents must disclose all relevant fees, commissions, and potential conflicts of interest.
- By creating an account on Listings.sg, agents explicitly agree that property listings they maintain on other platforms may be indexed and displayed on Listings.sg, with proper attribution to the original listing agent.
- Agents acknowledge that Listings.sg bears no responsibility for the accuracy, completeness, or legality of indexed listings, and that this responsibility remains with the original listing agent.
- Listings.sg reserves the right to suspend or terminate agent accounts that violate these terms or receive consistent negative feedback.
6. Prohibited Activities
- Creating false or misleading listings or impersonating others.
- Using the Services for any illegal purpose or in violation of any local, state, national, or international law.
- Harassing, threatening, or intimidating other users.
- Attempting to circumvent any security measures or technical limitations of the Services.
- Using automated systems or software to extract data from the Services (scraping) without Listings.sg's prior written consent.
- Interfering with the proper working of the Services or placing an unreasonable load on the infrastructure.
- Posting discriminatory content based on race, ethnicity, gender, religion, age, sexual orientation, disability, or any other protected category.
7. Fees and Payments
- Listings.sg may offer both free and paid services.
- For premium features, subscription fees will be clearly displayed before purchase.
- All payments are processed through secure third-party payment processors.
- Subscription fees are non-refundable except where required by law.
- Listings.sg reserves the right to modify pricing with notice to users.
8. Intellectual Property Rights
- The Listings.sg platform, including its logo, design, text, graphics, and other content created by Listings.sg, is protected by copyright, trademark, and other laws.
- You may not copy, modify, create derivative works, publicly display or perform, sell, or exploit any content from the Services without explicit permission.
- If you believe content on our platform infringes your copyright, please contact us with details of the alleged infringement.
9. Privacy and Data Protection
- Your use of Listings.sg is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.
- We comply with the Personal Data Protection Act (PDPA) in Singapore regarding the collection, use, and disclosure of personal data.
- We implement appropriate security measures to protect personal data under our control.
10. Limitation of Liability
- Listings.sg provides the Services on an "as is" and "as available" basis, without warranties of any kind.
- We do not guarantee the accuracy, completeness, or reliability of any content or listings.
- We are not responsible for any loss or damage resulting from your use of the Services or any transactions conducted through our platform.
- We are not liable for any disputes between users, including between property seekers and agents.
- Our maximum liability for any claim arising from the use of our Services shall not exceed the amount you paid to us, if any, in the preceding six months.
11. Indemnification
You agree to indemnify, defend, and hold harmless Listings.sg, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from your use of the Services, your violation of these Terms, or your infringement of any rights of another.
12. Termination
- You may terminate your account at any time by following the instructions on our platform.
- We may suspend or terminate your access to the Services at any time for any reason without notice.
- Upon termination, your right to use the Services will immediately cease.
- All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Changes to Terms
Listings.sg reserves the right to modify these Terms at any time. We will provide notice of significant changes through the Services or by other means. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
14. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of Singapore. Any dispute arising from these Terms or the Services shall be resolved exclusively in the courts of Singapore.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect.
